This Terms of Use Agreement governs your access and use of products, content and services offered by Great Dane Games LLC (GDG), Delaware-registered game development studio that creates and publishes original video games for PC and console platforms.
BY USING GDG SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE GDG SERVICES.
1. Obligations, Ownership, License and Fees
You must register with GDG to use your access and use of products, content and services offered by GDG. To do so You must be at least 13 years of age, agree to be responsible for your activities while accessing and using of products, content and services offered by GDG. GDG can suspend or terminate your account if you break this agreement. You may cancel your GDG Account or any GDG subscriptions at any time.
GDG allows you access and use of products, content and services offered by GDG by granting you a license not by selling you products or contents. This license grants you a personal, limited, non-transferable (i.e., not for sharing), revocable and non-exclusive license to your access and use of products, content and services offered by GDG for your non-commercial use. You may not access, copy, modify or distribute any GDG software without express written authorization.
Some aspects of access and use of products, content and services offered by GDG may require you to pay a fee. You agree that you will provide accurate and complete payment information to GDG or relevant third-party. If you violate any of the Terms, your rights under this license will immediately terminate, and GDG may terminate your access and use of products, content and services offered by GDG without refund to you.
2. License Duration
Your license is valid until GDG terminates it. GDG may terminate your license at will.
3. Rule of Conduct
GDG rules of conduct apply to you. You may not: modify, hack, reverse-engineer, or redistribute GDG products, content or services; resell, copy, or share GSG software or access to GDG keys; or use GDG products, content or services for commercial purposes without prior written permission.
4. Updates and Support
Access and use of products, content and services offered by GDG is offered on an “AS IS” and “AS AVAILABLE” basis with no guarantee that any access and use of products, content and services offered by GDG will be available at any time or in any location.
From time to time, GDG may update or modify access and use of products, content and services offered by GDG without notice if, at our discretion. You may be required to update and modify hardware and software to continue to access and use of products, content and services offered by GDG.
5. Refunds
Except as expressly disclosed in individual sale agreement, no refunds.
6. Intellectual Property
GDG own and reserve all rights, title and interest in and to access and use of products, content and services offered by GDG, and all data, meta data and content posted, generated, provided or otherwise made available in or through access and use of products, content and services offered by GDG, including, user accounts, game recordings and broadcasts, locations, graphics, structural or landscape designs, animations, sounds, software, titles, objects, artifacts, location names, stories, dialog, catch phrases, artwork characters, character names, chat logs, musical compositions and recordings, audio-visual effects, character likenesses, methods of operation and game “look and feel” (together know as “Game Content”).
7. Privacy
We collect personal information, both data you share with GDG and metadata (data about your data). We may sell or share your information with third parties.
8. Digital Millennium Copyright Act (DMCA) Notice
GDG is compliant with the DMCA. You agree to "defend, indemnify, and hold harmless" GDG from claims, damages, and losses resulting from your breach of the terms, misuse of the service, or user-generated content that infringes on third-party rights.

You are responsible for all costs and fees charged by your internet service provider related to the access and use of products, content and services offered by GDG,

IN NO EVENT WILL GDG BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS), WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT GDG HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.
12. Miscellaneous
This Terms of Use Agreement will be decided under New Jersey law (where GDG is headquartered), excluding its choice of law rules.
